    My petition for I-130 has been denied due to lack of evidence and was advised to appeal through EOIR-29.

    I don’t know how to fill this form. Lawyer is asking $1500 just to file this appeal which I cannot afford. Please let me know the steps in filing this form and how much information and documents do I need to fill this form

    The EOIR-29 form is very simple to fill. In addition to filling it you need to explain on a separate letter why you think your I-130 should be approved. You need to provide further evidence as proof in support of your I-130, i.e., relationship proof. The fee for this application is $110. You need to file this form within 30 days of your denial letter.

      Filing EOIR-29

      My I-130 was denied due to the lack of birth certificate. We do not have a birth certificate and provided with delayed birth registration/certificate which is unfortunately not considered as birth certificate. We also have provided two affidavits from real brother and real grandmother in support to proof mother/daughter relationship. We also have provided at least four other supporting documents but they still denied the petition. They only mentioned that they received only two affidavits in reply to RFE they sent. It has not been mentioned in the denial letter that they received and/or considered other four supporting documents such as heir ship certificate, sale deed of property etc., which we sent along with two affidavits. I am wondering if they have lost those additional documents and decided solely on the basis of two affidavits. Please let us know what kind of other documents/evidence we should submit to proof mother/daughter relationship.
      Furthermore, my lawyer is advising me to file a fresh I-130 petition and said that an appeal could take more than a year to decide and you may not get a favorable decision and it is very much likely that you can get a fresh I-130 petition approved much quicker than an appeal. One more question. Can I file an appeal (EOIR-29) and a new I-130 petition Simultaneously?
      I am confused and could not decide whether to go for an appeal or file a new I-130 petition. Please advice.

          Someone help

          Hi someone please help, we didn't bring any evidence to our interview because our attorney is useless. They gave us more time after the interview to send in more documents, and we sent one that was really important separate from the rest, before we sent the bulk of the items. They denied it for lack of evidence so we are filing an EOIR-29. Does anyone know more about this, and if we are going to be able to submit more evidence? Our useless attorney whose done nothing for us said that we can't submit more documents with the EOIR-29 to prove our marriage is real, but I don't see that anywhere.
