    Hi,

    My dad had already visitor visa when I filed for his GC consular processing as he was outside US at that time. But now his I I30 is approved is it advisable he can come in US on visit visa as rest of process still going to take time through NVC.

    Answer: It is really hard to predict the situation at port of entry.. If your father has valid visitors visa then they can travel. But, how the officer at port of entry will react on this situation is really unknowable.
    But I also add the point here is, In my circle people had entered to the USA with same situation.

      My mother entered the US with an approved I 130 on a visitor visa, there was absolutely no problem. I 130 doesn't mean that you are an immigrant it just establishes a legal relationship between the petitioner and the parent (in your case). Remember, the INS officers are there to protect citizens, not to harass legitimate folks trying to legally enter the US.

        Was your mother's I130 had consular processing mentioned? Did you or are you planning to apply for the I485 from here?

            My father's B2 visa expired in India in Aug 2020 and could not renew due to the COVID lockdown. In Dec 2020 I filed I130 - Consular processing - ( which is still under process with Texas Service Center) His case status shows now as usual: "We are actively reviewing your........".,. Don't know how long it will take.- for approval. According to USCIS B1/B2, visa interviews will resume in September. Therefore please suggest whether he should try to renew his B2 visa while an I130 petition is still under process for consular processing?. According to various posts on this Forum about I-130 processing, we anticipate a further delay of several months to get his green card approved. In fact, his intention is to visit us and return without overstaying and complete the Consular Processing.

            Appreciate the valuable suggestions of experienced members of this Forum.
