  • I-130 - Petition for my parents

    I was born out of wedlock but my parents got married when I was 10. My dad's name appears in my birth certificate. I'm attaching copy to the marriage certificate but the problem is that my mom was previously married in Guatemala 20 years ago but she's unable to get a copy of the divorce decree because they can't find in (in Guatemala). How can she prove her divorce? What if I don't mention that divorce since there are no records? Is that info. really necessary to be mentioned? Would USCIS check previous marriages in Guatemala? I don't want to lie but I don't want to complicate the case also? Please help..

    What kind of a case are you filing? Did she enter US legally? Lastly state the truth, do not lie as it can be grounds for denial of petition.
