Good afternoon,
I have several questions about immigration for my spouse who is a citizen of New Zealand living in Sydney Au. as a perm. resident.
Back in Feb 14, 2010 we were married in Jacksonville Fl. We met at a Biometric Conference in Sept 2009 we were both at the conference for business in Tampa FL. I work for Lockheed Martin in Rockville Md, Frank has owned his own business for 10 years and is the CEO of his Biometric Company in Sydney AU.
He was here on the visa waiver program (Business Visa) and was conducting business here in the US on several different occasions. We continued to see one another and about 2-3 months after dating he ask me to marry him, of course I said yes and we were married Feb 2010. He was still on his visa waiver for
his business as he was still conducting business as well.
We have completed the I 130, the 1485, I 693 G325,I 864, we had sent in the I129F however it was returned due to incorrect address, we have not sent it back in because we rec'd notice to appear in Baltimore Md i 797c application to register permanent residence or adjust status.
In order to comply with the notice Frank & I left the US to collect all the required information from Sydney for the meeting, and to comply with the 90 day I94 visa waiver timeline. We we arrived back into the states, he was detained and questioned and then deported on a technical of not having advance parole document, we did not even know of this document until we were detained and he was deported. He was told to get the correct visa. Now he is in Sydney and the meeting for USCIS is Thursday the 2nd of Sept. I plan to continue with the meeting, and provide all the documentation required, however Frank can not be there due to the deportation.
Need help to understand what is going on... can someone assist or put us in contact with someone who can assist?
