I am sponsoring for my husband and I need submit affidavit of support.
The house hold member number is 3.
According to I864 P the 125% comes to $22,887
My 2009 Tax return was $19,570.43
$22, 887.00-$19,570.43=$3,316.57
$3,316.57x3=$9,949.71
My question is would I need to have $9,949.71 in my account to qualify?
The question I have is how do USCIS calculate the amount in order to qualify? Do they calculate the amount based on the 2009 income tax on the annual amount from the employer? The original paperwork I sent with the form included a letter from my employer which stated I make $22,733.00/annually. I also included 2009 ($19,570.43), 2008 ($20,524.00) 2007 ($20,069.00) tax returns.
The first letter I received from the USCIS stated based on the documents that I submitted with the form I-864 did not meet 125% of the federal poverty line for the petitioner/sponsors household Size. The letter stated that I needed to submit evidence of assets that meet federal poverty line or obtain a joint sponsor.
I went to the bank and obtained a letter stating that I had $6000 in my savings account and the last 12 months of bank statements for proof.
Two weeks later I received another letter stating that USCIS was unable to complete the process with the information I provided.
The letter stated based on the documents I submitted the net value of the assets does not make up the difference between the sponsor’s income and the poverty guidelines, and to submit evidence of assets that meet federal poverty line or obtain a joint sponsor.
I am confused regarding the process, I don’t have a joint sponsor to help me to qualify but I do currently have $10, 000 in my savings account.
According to my calculations (see above) based on my 2009 tax return I should qualify if I can show proof that I have $10,000 in my savings account.
Any help with this would be gladly appreciated!
