  • Spouse GC before or after Naturalization

    I am gonna apply for my naturalization this Nov. My spouse is on H1 and i need him to be on GC. I would like to know what will be my best option to file GC for my spouse before i apply naturalization and adjust status when i have my citizenship or hold on my spuse GC till i get citizenship?

    I am really confused here and appreciate all comments on this.

    I would suggest apply right away as the waiting period is only from 4 to 6 months.

      Hi,,,you mean the time for I-130 approval has been reduced to 6 months?

        Yes, for GC holders sponsoring their wives or husbands. Please refer to Visa Bulletin. In near future there may be not be a wait at all.................

          Not just I-130 approval but the whole process to get the GC is about 4 to 6 months.................

              both! don't need a lawyer as it is pretty straight forward case. which state are you in?

                    Current processing is for folks who filed/have Priority Date of June 2010.

                      Do i need spouse birth certificate to apply I-130 & I-485? He is on H1 and can i know what all documents i need?

                        Sorry to bother you all. Can i know if this a policy change from USCIS to put the GC/Citizen petitions in same que of no visa limits?

                          There is no official policy change yet. They plan to make this category current and eliminate the F-4 category, this is what their plan is. As for what to and where to file, its plain and simple. Go to the USCIS site and download the required forms. Instruction do tell you what and where to file.

                              I am not certain, as i did not go through the process myself, but am speaking through a friend's point of view. I would first and foremost research the topic in great detail. And I would file as soon as possible. My friend got married in september and he and his wife (who is a citizen of Peru) are still waiting. The sooner the better! good luck!
