  • how an file when I am out of status recently

    Hello to you all,

I came to u.s august 2009 on f-1 visa, attended the school for three semesters. Before that I met a woman of my life whom we both fall inlove and got married just last october. in the last summer 2010, I did a summer job that was authorize by my school department chair but I did fail on my part to take the CPT paper to be aprove by the ISO.

Just last month on 15th october The director of ISO told me she will terminate my status because I did summer job without proper authorization from her and she went ahead and terminate my status, and ask me to file for reinsatement or I can leave the and re-enter country but she also said reinstatement is not gurranteed. I contacted an attorney and she told me since I am already married to a U.S citizen I should file for green card instead of reinstatement that is teh safest thing to do

But I am worried that the school will not allowed me to enroll in nest semester If I dont do the reinstatement.

    My confused questions are;
will the school allowed me to register for classes if tell them that I will be filing for green card instead of reinstatement and that I married to U.S citizen? will been out of status just 21 days now affect my filling for green card? will they ask me on interview while I fall out of status? will they not say that I should have file for reinstatement of my f-1 instead of filing for green card and because of this they might denied me green card?

have anyone been in this situation before?
Please I need your advise on what to do and please share your experience or someone else who have gone through this before.
    please help me.

    thanks

Since you are married to a USC, your out of staus will be forgiven. You need to go ahead and file an I-130.

      concurrent filing

In that you originally had a valid nonimmigrant status, you file a concurrent adjustment application package (I-130, I-485, I-765, I-131.)

filling for green card when out of status on f-1

Thank you so much for this advise.

But can I work now? because my former employer want me back at where I use to work. My wife and I have no sufficient money to spend for the whole process, but we are still looking for a joint sponsor. it is only wife who is working two jobs now and I am tired of seeting at home and been a house husband and I dont think that I can continue on like that untill I get EAD because I need to feed my family.

IF i contnued to go working now , will they not say that I work illegally during the interview?
        please I need advise.
        thank you

By law you CANNOT work but if you do, your unauthorized employment may be forgiven. Just make sure that when you fill an I-9 form, you MUST not pose as a US citizen.
          Good Luck!

can my spouse sponsor me when her last tax return was below $20,000

The immigration attorney just told us that since my spouse last tax return was less than $27,000 because we are four members in the household, then she can'nt sponsor me. But I tought she is above poovery level income. the attorney therefore told us to look for a joint sponsor. my spousee and I have been searching for who will help us but none, and it is just kind of frustrating when no one can help.

Has any one gone through this situation before? what can I do in this situation now? pleae I will need your advise!!!!!!!!!!!!!!!!!!!!!!!!!!!!

            Thank you all!!!!!!!!!!

It can be a friend, relative or an acquaintance. I am sure that you will be able to find someone.....
