  • Applying for Parents

I am a US Citizen living in US and wish to apply for both my parents through family based greencard. I believe a separate application for my mother and father will have to be filed. They have both lived and worked in US before and they had their Green Card too. For family reasons, they shifted from US to India long back. I believe my mother has enough social security credit for herself and my father also has some social security credit. I am trying to understand, if I file for them at the same time, how will the processing go? Will it go parallelly at the same pace? Also, Will I have to sponsor them fully or their social security credits will also be considered?
Are there any other better ways to get them here with me? Any help will be highly appreciated.

They are separate applications and may proceed at different speeds.

If they have earned 40 quarters of Social Security credits (including credits earned by their spouse during the period of marriage), they will be able to file I-864W and not need you to file I-864 Affidavit of Support. You can only earn 4 quarters a year so that would be at least 10 years (although since it includes credits earned by the spouse, if they both worked for at least 5 years during the period of marriage, it should be enough).

This is my personal opinion and is not to be construed as legal advice.

I am parent with 40 social security credits and filed I-864W and was ACCEPTED at NVC after an RFE as they did not know the law and I explained on phone. Now in the US embassy Mumbai interview they again do not know the law and was asking for my daughter income proof. What do I do in this case. But they did not give 221g for this but I got 221g only for my daughter domicile requirement. In this case do I assume they accepted the I-864W at embassy as I got no 221g for sponsor income proof or will I next 221g ? can they reject a form I-864W which was accepted at NVC. How does it work ?
