  • Quetsion on Travelling outside US post Green Card approval without physical GC card

    Request Advise please :
My parents GC got approved and the passport has the TEXT ON THE VISA THAT STATES “UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR” .

They came to US 3 weeks back and had flown Eithad Airways – the US immigration happened in Abu Dhabi ( not on entering US) , so the U.S. Customs and Border Protection (CBP) has “ not” stamped the passport with an admission stamp that indicates the immigrant has permanent resident status and has the date they entered the U.S.

Their passport was stamped in Abu Dhabi and says Class: IRS and Date stamp is one year from the date they entered US.

We are still awaiting physical Green Card on mail ( which I understand can take 2-3 months). My question is that my parents want to go back to India this month and since they wont have the physical green card when they come back to US in a few months, will the visa on passport be adequate for them ? many thanks

Yes, it is sufficient. The immigrant visa is no longer an immigrant visa, but turned into an I-551 (equivalent to a green card, which is also an I-551) valid until 1 year after their initial entry. They can use that to re-enter the US until 1 year after their initial entry.

This is my personal opinion and is not to be construed as legal advice.
