  • Advance parole question

My husband and I are trying to decide if we should apply for my MIL's green card while she is visiting us here (she goes back to India on Feb 14) or if we should have her apply when she gets back to India.

If she does it in India, we wouldn't be able to be there with her to help guide her through the process. If we do it now, we can do it before the fees go up, but we are nervous that she might not get the advance parole before she is due to go back to India. Can she travel to India on advance parole without USCIS considering that she has abandoned the application? She'll be coming back to the US again (this time, permanently) probably in late 2011 or early 2012.

Which way should we do the application?

You can't have both. If she is here, apply for AOS and wait till she gets her GC. If not then apply for consular processing and have someone help her out with the process in India.
    Cheers!
