First Preference Category(Unmarried Child over 21) GC

Hi,
My Finacee is 32 years of age and we got engaged for almost 1 year. His family is delaying our marriage because he is very close to his priority dates.
Current Dat going on is Feb 06 and his dates is June 06.

For this year all the visa's are over but we are hoping that it becomes current next year.

My questions is:
1. Can we get married quietly because we do not want to wait anymore? Does texas accept common law marriages.
2. Does anyone know when the Family Based First Preference category become Current

I am also in FB1 but my PD became current and I have filled i485.

DO NOT get married. His PD is is close and although Nov and Dec Visa Bulletin (VB) are very disappointing, just wait. If you get married his application will be changed to FB3 and if you see Dec VB FB3 for all countries is 01JUN02. That's more waiting than FB1 which is 15FEB06. DO NOT lie to USCIS, they will find out some how and then it will be all over. Just wait under FB1, it close.

I have being living with my girl friend for 5 years without getting married for this exact reason. I filled i130 back in Feb 2006, got approval in July 2009, and at NVC till Nov 2010. My PD is 13FEB06 became current in Nov VB. I filled i485 and now just completed Biometrics and waiting for EAD and interview later on.
