Can you obtain visitor visa while you immigration case under F4 category is pending. Petition was filed in 2009.

you can apply for visitor visa. It does not matter whether you have immigrant petition or not. You should satisfy the interviewing officer that you will come back after your vacation to US. Also you shud tick mark on visa ds160 form that you have immigrant filed for you.

F4 from India has around a 10 year wait time. It would be highly prejudicial to block you from visiting for a decade. As long as you can show that you will leave after a short visit, they should not block a B2 visa this early in your wait for an immigrant visa.Comment

well ...as long as you convince the counsul officer ,that you have ties back in india, you will be granted a visa. When I had mentioned that i have a immigrant petition on my behalf he asked me to satisfy that i will comeback.
I told him I am working for reputed company., Have never been involved in any crime or violated immigration laws etc ....The co granted me the visa.
