    I am planning to file I-130 with consular processing for my parents who are currently in their native country. The current processing time for I-130 appears to be about five months for where I reside. My parents plan to visit US in about two months on their previously granted visitor visa. My question is two-fold:

    1. Should we expect any issues when they land in US on visitor visa with the I-130 petition already in process?

    2. Once they are in US, how difficult is it change consular processing on I-130 to AOS through I-485 so that they can continue living here?

    I'd appreciate any insights.

    For you, as a USC over 21, to immigrate your parents you file two I-130's for them.

    They will probably be denied entry as tourists with the I-130's filed.

    If you hold off filing the I-130's until they come as tourists, they can file for adjustment BUT may be denied as having lied about their intent in entering as tourists. And in that situation they should be denied because they would have lied to gain entry. Then there is the added expenses of return flights and paying for consular processing AFTER paying for the failed adjustment attempt.

    You should just file the I-130's and wait for the Consular Processing of the Immigrant Visas and forget about any entry as a tourist in the meantime.

      Thank you for your insights. My parents have had the tourist visa for many years and have traveled to the US several times in the past 5-6 years. So they have used the tourist visa with rightful intent so far. Does that change anything?

        Every entry is based on the here and now.

        They ask the same questions for each entry.

        Circumstances change.

        They entered and left previously when visiting their LPR son, but now they would be visiting their USC son.
