  • New baby after Interview

    Hello,
    My name is Sameer Alomari, my wife is an American Citizen and we live together in Saudi Arabia, she filed I-130 for me and for my son, we had our interview on October, 30 2010, the officer requested a Joint Sponsor and a proof of petitioner's domicile in the USA in order to get our immigration visa.

    We have collected the required documents and we will send it soon enclosed with our passports to get the immigration visa.

    Please read the following situation carefully:

    We had a new female baby on October, 25 2010, and we want to know how my wife should file for the infant? Is there any way to accelerate her application and to join it to our application? We intend to immigrate once we get the visa and we can't wait for the long processing time of the new application, we've planned everything to travel permanently to the USA, we are selling everything we have here in Saudi Arabia including our furniture and my car, I have formally resigned from my current job, and I have terminated my current apartment lease.
    If the new application is not possible to be accelerated, is it possible to obtain a visitor visa for the infant? I know that non-immigrant visa applicant needs to show non-immigrant intent, but it is not possible! And we can't leave our daughter here!!! This is a Humanitarian situation, and we believe that this critical situation should be treated as an emergency case.

    If a visitor visa can be obtained for the infant, we will adjust her status after entering to the USA.

    Please, I need a detailed explanation to be able to take the right decision...

    Your USC wife had a baby? Is the baby a USC born abroad? IF your USC wife is unable to transmit USC to the baby at birth and it is not a USC traveling on a US Passport, the baby can be easily added to the Immigrant Visa. In either event, contact the US Consulate/Embassy immediately.

      Actually my wife is a U.S citizen and the baby was born in Saudi Arabia.
      My wife is not able to transmit USC to the baby because she left the USA with her parents when she was 1 year old!
      During the interview, I mentioned that we have a new baby but the officer told us that my wife should file a separate I-130 for the baby and it will go through the same process!
      Do I have any other options to join the new application to ours?

        Although they won't advertise it, the State department WILL automatically expedite the infant's case.

        Your wife's under 18 y/o unmarried children will automatically acquire USC upon entry as immigrants under INA 320. File N-600's for them after arriving in the U.S. and get them U.S. passports.

          I've sent an email for the Embassy and I hope that they guide me to join the new application with our case.

            The baby's I-130 will be easy to adjudicate, no background check required for an infant.

              What is my next step?
              Should my wife file I-130 and G325 in the embassy?
              When we'll recieve the medical examination instructions?not that the hospital request to show the appointment letter!
              Will we need to have one more interview?

              I am really confused about this issue!
