  • i-130 question 14

My husband came on b1/b2 visa his passport does not have an expiration date it has B-1/B-2 multiple indefinitely. So what should I put for question 14.Date Authorize stay expired or will expire?

The B1/B2 visa in the passport is probably a 10 year visa. At each and every entry, he is issued an I-94 which is stamped and has an expiration date usually 6 months after entry (check for addmission stamps in passport also). That is what they want.

In terms of seeking adjustment from nonimmigrant to immigrant, in general, the applicant has to have made a lawful entry into the U.S. as evidenced by I-94 or passport stamp.

For the Immediate Relative (IR) of a USC, they can fall out of status and still file for adjustment (I-485).

For the spouse or child of an LPR (greencard holder) or employment based, they can only file for adjustment while currently in a valid nonimmigrant status at time of filing the I-485 AND the priority date for the I-130 or other petition must be current.

He entered in 1994 and he has not left since, so he only has one stamp. So do i add 10 years to the time it was issued?
