  • GC for Parents -Consular vs I485 Process- Best Option

    Hello All :

I'm a naturalized US citizen and planning on filing GC for both my parents who might be visiting me around March 2011 in visitor visa.As i understood ,it could be done in couple of ways 1) Filing for GC by Consular Process which i can initiate right away while they are in india say Dec 2010 and 2) Adjustment of Status (I485) after they reach US.I wanted to get your expert opinion on which is best option both timing and convenience wise.

I also remember reading some where that it's a reccomended practice to file for Adjustment of Status after 2 months from the time they land in US. Is it a true statement. Please Clarify.

Either of those processes takes the same time in your case. if you file now, I-130 will take around 4months for approval, then starts your consular processing.
If you file once they come here (after 2months of arrival), then also it takes around 3-4months for the entire GC approval.

So, you have to decide which option is better for your situation.

      I-130 Approve for mother

I filed i-130 for my mother who is in India. Today her i-130 is approved by uscis and they send the notice too. How long it will take now to bring her in USA.

      Thanks

Approximately another4months. But it all depends on how fast you can get the documents, forms sent to NVC. I'm also in the same boat now, I need to start Affidavit of support for my parents now in the Consular process stage.
