I am currently on an h1-b and have an Eb2-employment-based green card also in process(It is past the labor clearance stage). Recently I got married to a US citizen. My husband (US citizen by birth) and my employment situation has been causing us to live a few hours apart (in the same state). So we are currently in different addresses although working towards moving to the same place by changing employment, but this is not exactly very easy in the current economic environment.
We are considering the option of initiating a Family based Green Card for me. I have a couple questions in this regard:
1. Can a green card application be made on my behalf under the 'family-based' category while an 'employment based green card' is already in process? Would the employment based application have to be stopped in order to start the family-based process?
2. For the family based green card while filling the I-130 form, we would essentially have to put in different addresses for husband and wife. I've been reading online, that separate addresses tend to raise suspicion regarding validity of a marriage. Would this really be very problematic for our application? Is there any way to get around it, besides moving into the same place and commuting many hours back and forth from our workplace everyday?
I would appreciate any advice on how to approach our issue.
