Hello ,
I married my wife who is a USA CItizen, and I was on H1B visa and recently converted to EAD status. My Wife's i130 for me is Approved, but I received an i-485 based RFE on 3 topics from a local field office in Norfolk Virginia. I am wondering if this is unusual ? Should I consult an attorney ?
In my latest June 2023 RFE of i485 , they are asking for 3 things in my RFE:
A. Submit evidence of a lawful admission or parole into the United States (i94, copy of h1b visa, visa and expired visa, F1 student i20 etc. etc.)
B. I-693, Report of Medical Examination and Vaccination Record.
C. Evidence you and your wife share a marital life together (joint ownership of property, mortgage, joint bank account, Birth certificate(s) of child(ren) born to the spouses, wedding pics, Sworn affidavits of Marriage, etc. )
This is my Timeline :
May 13, 2022 : i130 filed ONLINE
July 7, 2022 : i485(AOS) + i765(EAD) + i131(AP) + i864 + i693(Medicals) sent paper forms
July 26, 2022 : RFE on i485 for my missing Birth Certificate
Aug 10, 2022 : Biometrics
Aug 25, 2022 : Response to RFE on Birth Certificate sent. I sent original Birth Certificate to them in my response.
Feb 7, 2023 : Approval of EAD and AP Combo Card (i765 + i131).
May 11, 2023 : Approval of i130
June 20, 2023 : RFE on i485 from Local Field Office in Virginia received.
I received RFE on i485 after the approval of my i130. I am wondering if this is unusual ?
I believe I have most of the necessary documents to respond to the above RFE. I am wondering if anyone has received similar and a lengthy RFE in the past ?
Do I need to review an Attorney to review my RFE and my Response ? Do I need to hire an attorney to represent my case ? Please give any advice ?
