  • After I-130 Approval

I applied for i485 separately from my wife's i130 petition in 6/21 (wife is LPR). She received a notice that we had an interview for the i-130 petition 9/11 and today we received an approval notice for same. Meanwhile, my i485 application only updated with the i130 interview date saying something like "case is being processed and nothing outstanding at this time."

Has my case been sent to the visa center to process my greencard you think? My i485 application was submitted in 8/21. Also, was the interview for a conditional greencard or without conditions? We've been married for over 2 years if that's any help.

Also, when I enquired about the status months ago through EMMA, an agent told me that i485 interview was waved.

I know I have a lot of questions, so I thank you for taking the time to respond.

Even if they sent the approved I-130 to NVC, if you filed I-485, USCIS will automatically ask for the approved I-130 back. You don't need to do anything.

If you will have been married for 2 years on the date you become a permanent resident (i.e. when your I-485 is approved), you will become a non-conditional permanent resident. Since you have already been married for 2 years now, that means you will have been married for 2 years on the date you become a permanent resident.

This is my personal opinion and is not to be construed as legal advice.
