  • k1 visa to now i 130

us citizen petitioner files a petition i -129 for k1 visa (same sex marriage ) petition was approved and sent to us embassy for interview . beneficiary changed her mind and decided not to get married and didnot filled DS-160 form and skipped visa interview .after one year embassy cancel that registration and petition .and after one year she got married with different US citizen ( opposite sex ) now they are planing to submit i 130 . the question is if new petition can revoke under section (204 C ) bar or there will be no problem at all . thanks

Shouldn't be any problems. Fiancee decided she didn't want to be fiancee, and didn't get K1 visa. That was perfectly fine. They would need to disclose on the I-130 that a petition was previously filed for the beneficiary.
