  • F31 and student visa

    Hello

I am currently in the US on f1 student visa. My parents recently got an interview date for a green card (F31).

I had a few questions regarding my status change:

Q1) Can I do my medical examination here in the US or do I need to do that in India? (Since the interview date is during an ongoing semester, I don't want to miss many days of college.)

Q2) Once we become green card holders, is it necessary that I travel to the US with my parents? Is it okay if we travel separately on different dates?

Q3) Is there anything else I need to be mindful about?

    Thank you!

It depends on whether you are doing Consular Processing at the US consulate in India, or you are doing Adjustment of Status inside the US. If you are doing Consular Processing abroad, I believe you will need to do the medical at a place abroad designated by the consulate.

If you are doing Adjustment of Status in the US, you will have to wait until your parents enter the US before you can file I-485 (and you need to remain in status until that time), and you will do the medical at a USCIS-designated civil surgeon inside the US. Also, you cannot leave the US while your I-485 is pending unless you have an Advance Parole.

No. Once you get your green card, your status will be completely independent from theirs.

This is my personal opinion and is not to be construed as legal advice.

I will try to give you an answer to all your questions. 1. You can undergo a medical examination in the USA, but it is better to clarify this issue with the consulate. There may be options for students to minimize absences. I went through all this and at the university I used a writing service, I found https://ca.edubirdie.com/ for this. It was a good way for me anyway. 2. After receiving your green card, you do not have to immediately return to the United States. You can come later separately from your parents. The main thing is that entry occurs before the visa expires. 3. It is important to renew your student visa before receiving your green card and keep an eye on deadlines. It is recommended that you contact an attorney or DSO for advice.
