  • I-864 Please help

    Hi,

    My husband is filing I-864 for me.
    He was born in USA but moved here only 4 months ago.
    He's working since oct 2010, which means we don't have proof of income because he gets 1099 in the end of the year.
    I know he needs to file for me I-864, but we don't know what to write in the "sponsor's income and employment" - yearly income or just those 2 months.
    He makes 800 a week so it's more than the poverty guidelines but we can't show it yet, until he files for taxes.
    I have a good friend that will be my joint sponsor, he makes more than enough, is he considered the only joint sponsor in the I-864 or is he the second of 2 joint sponsors.
    we're trying to figure out how to fill out the I-864 for my husband and our other sponsor, since we're not using a lawyer.
    Please help!!

    Your good friend will be the only Joint Sponsor and have him/her fill I-864.

    Your husband should also fill I-864 as the main sponsor. I know you dont have end of year tax forms but if possible get a letter from his work stating the yearly salary. It will help.

      The I-864 that my husband file : Do I need to write his annual income and in addition to get the letter from his company?
      because for my understanding his salary is enough to sponsor me, so it won't look weird to have another sponsor?
      or is it ok because we don't have the taxes to show.

        When you get a letter from his employer confirming his annual salary, write that amount in this annual income. Also put the 2 or 3 salary slips he has in the documents as well.

        Have the joint sponsor because just incase the NVC/USCIS decides that the I-864 from your husband is not enough then you won't waste time then to hunt for the joint sponsor.

          Hi Orithib,
          I am in a similar situation: wife is USC, just arrived to US last year, working since 10 months ago, salary way above poverty lines, never filed taxes before, not using a lawyer.

          One question for you: do we (immigrants) have to file an 864 too? or just the sponsor and/or joint sponsors? It was not clear to me in the instructions.
          I was advised to wait some weeks before sending the papers, file a joint-tax return with my wife and then apply for green card. Seems reasonable to me.

          I could also be my own joint sponsor since I make more than enough, but I would try to avoid that for the same reason that you said: "because for my understanding his salary is enough to sponsor me, so it won't look weird to have another sponsor? "
