I plan to apply GC for my mother. She arrived in US <1 month ago on B2/Visitor's Visa. I was told that one should wait at least 90 days before applying for GC otherwise USCIS may deny the application based on reason that recent B2 non-immigrant entry was done truly with an immigrant intent, and hence purpose of visit was misrepresented at entry.
Is this correct? Should a wait time be necessarily followed? Thank you for your advice.
