GC Application and Minors

I am thinking of filing for my brother. He has a son who is a minor now but will be a major by the time their priority becomes current. I had few questions about how this will affect him.
1) If I apply just for my brother and sis-in-law will my nephew automatically get included in the application.
2)Nephew wants to come on his own on a student visa in a couple years. Will this GC application for my brother reflect negatively on his student visa application? Even if I dont include him in the application for my brother?

1. You only file green card petition for your brother. You can't really file for his dependents. You have to include the names of his dependents in the application, including nephew.

2. That may possibly be a problem but you can't avoid it.
