I am reaching out on behalf of my sister's grandchild, who has been living with me alongside my sister.
My sister has been his guardian since last year, having obtained guardianship before leaving Venezuela so he could accompany her. He was 17 at the time and has since turned 18. Recently, I became aware of the Special Immigrant Juvenile Status (SIJS) and its potential applicability to his immigration situation. However, I understand that the eligibility and process may vary depending on the state of residence.
Currently, they both hold humanitarian parole status and have applied for Temporary Protected Status (TPS). They have obtained work permits as well. My question pertains to the timing of the SIJS process here in Missouri. Is it necessary to initiate this process before turning 18, or is it still possible to pursue a family court predicate order now that he has reached adulthood?
Any insight or guidance you can provide on this matter would be immensely appreciated.
