  • Dad's I-130 approved, am I CSPA young enough or is ChatGPT wrong?

Hi all, I'm trying to calculate my CSPA age and I'm a bit confused.

My birthdate is 28/08/1994. I am 30 years old.

These are the dates for my dad's petition from his mother.

December 6, 2011 We received your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan.
April 23, 2015 Case Was Approved

No word since then, and then on October 22, 2024 my dad received an email stating the NVC has received his application and is ready to begin processing, and to pay, submit documents and book an interview.

According to ChatGPT, I am well within the CSPA age since it seems like October 22, 2024 is the date the visa became available, and I am CSPA 16 years old? Can this be true?

Also, my dad hasn't added me to his application yet, but there is an option to add child / spouse on the website where you can submit documents / pay fees. Would it be any problem if he were to add me now?

Lastly, and thank you for reading this much, my dad has since moved from where he originally applied from, and has gained another country's citizenship but still holds the original country's citizenship. Does this affect his application negatively in any way or is it just a matter of informing NVC about the change in address and moving onwards? Because on the website it says his interview date is in the country where we resided at the time of filing the petition.

    Thank you!!

The I-130 was pending (i.e. from filing to approval) for about 3.5 years. Therefore, you age out at around age 21+3.5 = 24.5. If a visa number wasn't available when you were age 24.5 (and it sounds like it wasn't), you have aged out.

This is my personal opinion and is not to be construed as legal advice.
