  • Approved I-130 not sent to NVC

I filed an I-130 application for my sister who lives overseas. The application was filed in May 2007. In November 2009, I received I-797 approval notice indicating that the petition was approved and sent to NVC.

In April 2010, I checked the status in the NVC system and found that the case is missing from the NVC system (does not have NVC case number) even after 6 months of being approved. I emailed NVC and they told me to contact the USCIS california office.

I called UCSIS and the lady on the phone told me that since the priority date is not current, the file has been 'archived' and will sit there until the dates become current. Is this normal practice? I thought that once the I-130 is approved, the case is sent to NVC immediately. Is there anything I can do to have approved petition sent to NVC? I want to ensure that this approved petition does not fall through the cracks. Thanks.
