    Hi,

    I am a permanent resident since Nov 2007. I got married in May 2010. My husband is in US on F1 visa. I filed a petition for him in Aug 2010. We have been checking the visa bulletin regularly and still our priority date has not become the current. My questions are...

    1) If the PD becomes the current and we file an adjustment of status(I-485) for him what will be his status then after? Will he still be on F1?

    2) After we file I-485 how long does it take to get the new status?

    Hi,

    When my attorney received back the notice of action from USCIS, my status indicates that my status is PR pending.

    I have a similar case as you're, i will file I-130 for my spouse (F1 visa). I'm LPR. When is your husband F1 Visa expire or the end of study?

      The status will be a GC holder only after the I-485 gets approved and interview is taken and passed. Make sure that he/she does not go out of status.

          I applied for I-130 for my husband in Aug 2010 and we got notice of approval in Dec 2010. Now we are checking the visa bulletin regularly for next step.

          My husband still has about 4 yrs of F1 visa remaining.

              1) Yes, he still will be on F1 until you get approval of I485
              2) In about 1 month they will invite for biometrics. In about 2 months after that they will invite for an interview. Normally they will tell you during the interview that they approved your I485.
              But the news are bad this January - the PD rolled back to Jan2008... (from Jun2010)
