  • Alien Immigration petition I-130

    My uncle had applied for alien immigration petition for my mom (his sister) and her family around 10 years back. Now, he got a mail from nvc that the petition is approved and that we have to $400 each per family member in the petition.
    Now, my dad and my brother are not interested in immigrating to the US. Is it possible that my mom and me pay the fee for both of us and immigrate to US or is compulsory that all of us have to immigrate together?

    Yes, in your case main beneficiary is your mother so your mother and you can choose to migrate.

      Many Thanx for your quick reply. I just have one more question.
      My mother doesn't want to live in the US permanently and she will go only so that i could get the green card. Is it possible that she gives up the green card later on without that affecting me. And after doing so, will she be ever permitted to enter US with a non-immigrant visa?

        Once you and your mother acquire the GC's she can leave anytime and abandon her GC. Her departure will not affect your GC. As for future, if her GC is abondon, she will apply for a visitor visa and there are no guarantees.

        Seems like only you are interested to come to US. Have you ever been here? Seems like your family is well off in your country and not interested in starting over. I would think twice!

          I would agree with daru786 that your mother can abandon her GC after entering US.

            How much time does it take?

            i think i have decided upon going to US and will be accompanied by my mother. Thanks very much for all ur help people!!

            Just wondering that if i pay the fees to the nvc by march (the deadline is till september), then, how much time will it take for the complete process to get over and me receiving the immigrant visa? anyone who had a similar experience can help me with this
