I hope you can help.
I am trying to find out the proper process to follow for my daughter. She met her boyfriend in the US last year while she was working there on an H2B visa, the contract ended November last year and she came home to South Africa. She is now going across again in February this year on an H2B visa to work for the same people. Her and her boyfriend would like to get married but don’t know the procedure to follow. My question is as follows:
While she is in the US this year on her H2B visa, will she be allowed to marry him and they apply for the marriage visa while she is there? If they get married while she is there on the H2B visa and apply for the marriage visa, will she be allowed to travel back to SA for a short period while the marriage visa is being approved and be allowed to enter again? Or would she need to stay on after her H2B visa expires while waiting for the marriage visa to be approved?
Or if the above is not allowed:
Must they apply for the fiancé visa while she is in the US working on the H2B visa so they can possibly get married while she is there if it gets approved, or must they wait till the H2B visa expires and then only apply for the fiancé visa and if that is the case do they apply for it with her staying on in the US after the H2B expires or does she have to come home and they apply for it while she is in South Africa?
Would really appreciate an in depth (layman terms) and understandable response J
