    Dear All,

    I need some advice.

    My wife is having green card and completing 5 years in USA. She is appplying for citizenship by May. We have a four months old child who born in US and bydefault he is a US citizen. They are planning to come to India for a short visit and I am also planning to join with them while going (on B1\B2 visa) as she cannot manage the child alone while travelling and for the next few months. We have not yet filled for my green card since I am a frequent traveller to US using B1 visa. Now I want to apply for greencard and join to family at the earliest.I dont want to do anything illegal. I understand that doing adjustment of Visa while I entered country using B2 visa is illegal. Its not my true intention too...

    I want to spent time with my child and wife and during that time we want to apply for my greencard. Should I need to come back to India consulate after she gets citizenship and when I am trying for greencard. If the petetion is fileing while I am in US, if required is it possible to take the interview from India consulate?.Could you please advice whats best for my case. Thank you.

    She needs to first file for green card petition. She can file that right away. https://www.immihelp.com/family-based-greencard/

    Once it is approved, if you are in the U.S. at that time, you can apply for adjustment of status. If you are in India, you can apply for Immigrant visa. Read http://www.immihelp.com/green-card-process/
