  • I130 approved next steps and AOS

    Hi,

My sister who is a US citizen filed I130 for me. I am currently on OPT and I received a notification from USCIS saying that my application has been approved and will be sent to NVC for further processing. I got this notification in Sept 2009 and the priority date for my application is 2005.
Can you please let me know when can I file for adjustment of status and whether I can file for adjustment of status. What are the next steps in greencard processing and what impact will it have on my H1B processing. My company will file H1B for me this year.

    Thanks!
    Jive

You can apply when priority dates for your country and category are current. Check DOS website for the latest Visa buletin.
This has nothing to do with your H1 petition.
This is my opinion and not legal advice.

Just a quick question. Did you brother apply for your greencard before you got your OPT or after that. I am asking because I want to apply for greencard for my sister who is on a F1 visa and I have heard that she can have issues when applying for her OPT. If you could share your experience that would really help.

Also, how long did it take for you get your I130 approved.

      Any help would be appreciated.

      Thanks
