I have one question regarding question #16 of I-130, has your relative ever been under immigration proceeding? I am filing I-130 for my brother.

my brother applied for non-immigration visa (tourist visa) in 2008 but it was refused. Does this visa refusal comes under immigration proceedings? Please help, how to answer this.
