I have been doing a bit of research on trying to figure out if I am
eligible to live in US by getting sponsored by my father. My father is
an American and holds a US passport. I've been trying to put the
pieces together.
Here is the background of the situation: My father is a U.S citizen
but currently lives in Australia. He lived in the States until age 14
when his family moved out to Australia for 3 years then moved back to
the U.S. My father stayed in Australia but has returned back to the
U.S on a regular basis over his life travelling on his U.S passport.
All of his sisters and our family still currently live in the US.
I know there is a certain requirement of physical presence in the
United States that my father must meet in order for myself to be
documented as a U.S. citizen and I know that it does not have to be
consecutive years. Because I was born after November 1986, then my
father would have to submit documentation to demonstrate to a consular
officer's satisfaction that he was in the U.S. for at least five years
prior to your birth, with two of those five years occurring after he
was 14 years old.
However I'm not sure if my father will meet these requirements because
its virtually impossible or extremely difficult to prove documentation
and to demonstrate that he was in the US for two years after he was 14
years old. I know this will be really hard and if we cannot prove
this, what happens?
Would my father be able to petition for an Immigrant Visa (IV) so that
I could immigrate to the United States and become a U.S. green card
holder (i.e. a permanent resident)? What kind of requirements are
needed for this, what forms do you need to fill out?
If you could please provide me with any information I would greatly
appreciate it.
