  • i130 for spouse and newborn status

    hi...
I have filed i130 for my wife. I have a green card. I checked some forums and according to them, I have to file I130 separately after baby is born and wait for Visa Number. Someone suggested that if the baby is born after issuance of Immigrant Visa, mother can bring the child without Visa before 2nd birthday of the child and Mother’s first visit to US. I am confused why can’t I bring the child as I am already a LPR. Is this law different for mother of the child.
My question is how to bring baby born outside US:
    1) After i130 is approved and visa number is not yet available
    2) After i130 is approved and visa number available but consulate is yet to give visa due to processing delays
    3) After Consulate has already issued a Visa

hi I think you should ask USCIS directly or email the consulate of your home country. They will advise you what should be done.

I dont agree with Raven's advise on familybased forum.
