  • Question regarding I-130

    Hi,

I am filing for my spouse who is an F-1 student. What do I input in the "Date Authorized Stay expired, or will expire ..." section ? Also, what would be the date arrived ? Is it the last time he arrived the US, or the first time ?

Also, about how many proof of marriage can be sent with the I-130 application ?

    Thanks for all help.

Date arrived - Last arrival date.

Date Authorized stay - I-94 date. (If I-94 says EOS, then I-20 date).

    One proof - marriage certificate.

      Re: Question regarding I-130

      > Date Authorized stay - I-94 date. (If I-94 says EOS, then I-20 date).

Where on the I-94 or passport am I supposed to find the expiry date ? My sisters' I-94 has no date that I can even see or even the words "EOS". The passport says "F1/OPT". My sister had applied for a STEM extension and a new I-20 was issued. Subsequently she transferred to an H1 and a new I-94 has been issued.

What date do I put here
      1) Date her current H-1 visa status expires ?
      2) Date her STEM extension issued I-20 expires ?
      3) Date her original I-20 (issued after initial OPT application) expired ?

      Thanks.

The I-94 form does not have "EOS" or any Date Authorized Stay. Instead, it reads something like " D/S " (handwritten) . Is it the same thing ?
