  • Filling out I485 for EAD holders-Current USCIS status?

    Hello all,

    I am a US citizen, and my husband is applying for I485 Family Based. He came to the US on Employment Based and got his I140 approved and is holding a EAD for a couple of years already, but his I485 EB is still processing endlessly.

    Therefore, he is applying I485 FB now and we have a question for filling the I485:

    1) Since he is holding EAD and is AOS pending, what does he put for Part I "Current USCIS status"?

    2) When sending in the I485/I130 package, do we also include a copy of the EAD, and the NOA for Biometrics for his AOS pending EB?

    3) For Part 3, " have you ever applied for permanent resident status in the US", he would answer "yes," and provide the "SRC" number. He has a LIN number instead, is that the same thing?

    I'm a newbie at this, your help will be greatly appreciated!

    2. Yes. A# is the one that will be used.
    3. SRC, LIN, EAC are all the same and vary by the center processing the application.

      My husband's I94 is not stamped with Parolee, is he really in the Parolee category?

      Actually, tihs matter has troubled us for years. Because he does not have the required documents to prove that he is "eligible noncitizen," he is not able to obtain financial aid in college.

      the required documents are I94: Must be stamped as a Refugee, Asylum Status, Conditional Entrant (before April 1, 1980), Parolee, Cuban-Haitian Entrant.

      He only has an expired I94 not stamped as one of those, and EAD.

      My ultimate question is, what documents are needed to prove that he is eligible?
