    Hello,
    If my petitioners form I-130 is approved(was approved on '09) and I am waiting for a visa no. to be available, under the category of US citizen filing for a married son/daughter. Can I apply for a work permit while I wait for my application to be current so I can apply for Adjustment Of Status? Will I have to wait 10 years to be able to apply for the work permit?

    you can apply for work permit..while waiting for your visa number to be available. After getting workpermit you can apply for adj of status once you are in US

      I was told i cannot apply for a workpermit.I am in the US,unmarried an over 21 and my approval was in 09

        You cant do anything till you get the immigrant visa which will lead to GC. No SSN, DL, EA etc.

          Yes AOS to a US Citizen

          If you marry a us citizen you can submit all applications along with the I485. The i765, i-130, and i864,G-325A's of you and your husband. I am in this process now and I did everything myself. me and my hubby!

            To answer your question, you need to precise where do live now and what is your current status (if live in USA).
            Anyway no matter where you are if you don't have visa number available, you cannot get any immigrations benefits at the moment. Approved I-130 means only that USCIS agree that you are related to the US Citizen parent base on the evidence ( birth certificate, parents birth certificate and others documents that you submitted), but nothing else. I-130 is just the basic thing in immigration process and it does not guarantee or give any benefits. Relatives of US citizen such as spouse, parents and children under 21 are classified as " immediate relatives" and do not have to wait for visa number; it automatically available for them to adjust to permanent resident)
            In case, you live in USA ( overstayed or student), you need a lawyer: just schedule a consultation and ask what it is possible for you as benefits ,and how long it will take. Especially if you are here in US as out-of-status ( or overstayed your visa over 180 days); YOU DEFINITELY NEED A LAWYER to help! Good luck.
