  • non-US citizen Marriage with US Citizen

    Dear friends,

My sister is getting married to a US citizen and will be applying for GC from outside US (India).

Does anyone know what is the present wait times for GC processing in such cases ?

Addtionaly, I am assuming that this would take a couple of months for getting a GC when we apply for the same from India.

Is it possibly for the girl to visit US on a B1/B2 visa after marriage and travel to US and apply for a GC within US after entering US ?

Is it possibly for the girl to visit US on a B1/B2 visa after marriage and simultaniously apply for a GC from India before travelling to the US ?

Your responses and suggestion would be highly appreciated.

    Warm Regards,
    Deep

The two options you describe are rather tricky/risky. She should really examine which "ordinary" option is best:
    1. K-1 fiance(e) visa (requires marriage in US, AOS afterwards)--much better than B1/B2 option (similar process at foreign end, but less likely to get rejected by CO or Immigration official)
    2. K-3 spousal non-immigrant--shambolically designed, but allows what you described
    3. CR-1, immigrant visa issued at Consulate (variety of this is DCF, Direct Consular Filing

Hi svaradara, Thanks for the quick response and suggestions.

I heard that the wait time of spouse (non-US citizen) would be around 3-4 months, if one goes through the GC process. Can you please confirm if the same true ?

Also can you tell me what is the wait times for k3/CR-1 visa and the diffirences between. I am very sorry, I don't understand much about the legal/immigration terms.

Also met a consultant locally, who was promissing me that he would get the GC done in a 1/2 weeks. But I am afraid, he sounds very ****, after reading a lot over the internet. I am really grateful to god that I found this forum where people are more open about public information rather that these consultants.

Kindly provide me your advice, I do really appreciate any help.

      Thanks again, Regards
      Deep.

1-2 weeks? I haven't yet heard of USCIS processing any form within that time--this guy is about as real as a $3 bill.

USCIS processes each case according the time and no one is above the law! Get it! Unless the application can be expedited which is not the case of any type of Green Card, so be careful with this consultant!!! Good luck.

Better you ask your sister to have a look fiancee visa process for easily getting into the United States.

The fiancee visa process is not difficult, yet it is important that all the paperwork and supporting documents are carefully completed and compiled.

After Getting married, Now it's time to apply for an Adjustment of Status (AOS) to become a permanent resident. It is important to file for the AOS before the K1 expiry date, otherwise you will be out-of-status.
