GC Filing question

Hi, My h1-b extension in pending stage and my i-94 is expired on 15th June. As per rule i can stay 240 days the day i filed for h1-extension.

I got married to US citizen girl and we are about to file family based GC. Since my i-94 is expired, does that create any problem for me? when i file for GC, i will be considered as out of status?

Please advice.
