I applied I-130 for my mother last year and I received the denial notice and to apply for appeal.
One of the immigration attorny said, do not do the appeal as it takes more time and apply fresh when you have all the information.
They need more proof to prove the daughter and mother relationship and I feel DNA test is the only option. My father expired 34 years back and i do not have their marriage certificate also.
DNA test is a long process as she is in India.
Few questions:
1. Can I apply for her visitor visa and get her here and apply fresh I-130 for her?
2. If I apply for her visitor visa, there is question in the form that asks if she has been applied for immigration status before and if I say YES, will there be an issue of not giving the visa?
3. Is the DNA test easier if she is here in states?
