  • B1/B2 visitor visa to green card

    My dependent (mother) is in the USA currently on a visitor visa, and her return trip is scheduled for 9 Aug 2011. In the mean time we've started her green card process. Her finger printing and biometrics are completed. My question is can she stay legally in the USA beyond 9 Aug 2011, in case she does not receive her approval before that time. Pl. advise.

    No. She has to return to her country before the expiration of her entry (I-94) form. She can go back to the US again if her B1/B2 visa is multiple entry and has not expired yet.
