  • I130 Petition & I485

Does my wife need a birth certificate for filing I130 and I485 (adjustment of status) petitions. I am a US citizen and she is currently in USA on H1B visa. She does not have a birth certificate. If required what is the alternative?

    Yes she does

Yes she does need a birth certificate. If she doesn't have it you can try requesting one from her hometown (govt. issued). Usually y can get it from the place (hospital) she was born in or a city hospital.
I didn't have one either but my folks sent it to me from India (Chandigarh). They will take Rs. 1500 - 3000 and make a new copy. Make sure if get everything in English otherwise you will have to get it translated by someone (costed me $30 to do that).

    hope this helps

      Hello helloimmiworld,

Could you please confirm if I can get birth certificate from district registrar from Civil Hospital in rural area of Punjab. Would that be considered as a valid one as I was born in a rural area and at that time no one cared about birth certificate.

      Thank you in advance.
