  • Intriguing Questions!

    Hello all!

I married my girlfriend a few month ago,
and now about to file for a Green Card (I-485, i-130, I-765, etc.)
Now I encountered some questions I could not find a decisive answer to,
and would appreciate it very much to hear your input on these matters.
    So here we go:

    1. I overstayed my I-94 for over a year (entered US legally of course, on B2 visitor).
Does that mean i'll have to file I-485a as well and pay the $1000 'Fine'?

2.Can the overstay period cause me any other complications?

3.I own a business, me and my wife's brother are partners in that business.
I don't work there, i'm just the owner, which I know it is perfectly legal.
I got a business tax ID and doing everything by the book. My question is, should I mention under 'current occupation' that I'm a business owner? should I disclose this information somewhere else? Cause I didn't see any question regarding this.
Also, could this count as evidence of bona fide marriage, since my business partner is also my brother in law?

4.My wife did not file her taxes for the last couple of years. (laziness, nothing more..).
we are going to do it but it could take some time cause it's quite complicated as she used to own a business and is still trying to figure everything.
Since we are going to have a joint-sponsor, does it matter if on record it shows she didnt file taxes yet?

Any input will be greatly appreciated,
    Thank you all!

Your overstay may be forgiven because of your US spouse! I don't see any problem in your statements ( questions) above. As long as you have proof that you entered in a genuine marriage, you are fine. Just go ahead and apply for your immigration benefits. Say the true and nothing but the true in your application and at your interview! One advice, if you are not totally satisfied with the advices here, consult a lawyer before any immigration process. Wrong help can hurt sometimes! Good luck and share with us.
