  • urgent question-i140 approval

    Hi,
My father's company had initiated his green card processing in july 2002 under the EB3 category and he had also put my name for the green card processing during that time. My father and my I140 got approved on Feb 20, 2007. However, on April 18,1986 ( that's the date I turned to age 21) our lawyer informed us that I could no longer be part of the GC processing since I had become an over age dependant. Currently, I am working for a company with an H1B visa and the company wants to file for my GC processing. Is it possible for me to use the priority date of 2007 for my I140 since it was already approved before I turned 21?? I would appreciate if anyone can help me out in the matter.

No, you can't. You never had I-140 approved. I-140 was only for your father and you were just listed as a dependent.
