  • Sbiling I-130 - Birth Certificate question - Help Please

    Dear All,

    I am planning to sponsor my brothers and working on the requirements. One of the requirement for filing I -130 is that person should have valide birth certificate.

    My question is what if person does not have birth certificate since he was born at home or during that time, having a the birth certificate was not in system.
    Can I use their high school degree or certificate as the proof of birth certificate? Can you please tell exactly the steps or process to deal with this situation? I am stuck at this point.

    If he cannot obtain a Birth Certificate from Government, you can use sworn affidavit from two people(relatives) who have the knowledge of date and place birth of your brother, If your brother already has a passport, make sure that the date and place of birth on affidavit matches with passport data.

      Template of Affidavit if no birth certificate is available?

      Hi Dhira_98 and others,

      Where can we find the template / language of this affidavit ? is it given some where on INS site or this is something we need to obtain in India ?

      Does these two relative needs to sign off this Affidavit in the presens of a Notary ? Or certify this affidavit by Notary?

      Please provide some clear guideline. Thanks in advace for help

        Don't worry about it. Gather as many document from your school showing common names of your parents. You will be fine.
        In case you want to submit affidavits also, use plain simple english of someone affirming under penalty of purjury that he/she is aware of your relationship and also since how long.
