  • I-130 sibling (brother) - does country of origin matter

    Dear all,

I'd appreciate your opinion on below questions:

I’ve just become US citizen and I’d like to file a petition for my brother, who lives in UK and has dual citizenship (UK and Serbia).

-From a processing time perspective (due to country limits), does it matter which address I quote for my brother, since he maintains both UK and Serbia address.

-Can he file I-485 concurrently if he enters US on a tourist visa? If so, would that expedite the processing time in any way ?

    Thanks in advance!

    1. You have to go by country of birth.
    2. No. He will have to wait for the priority date to be current first, which would be around 10 to 12 years from filing.
