    Hi, I would be appearing for my F2B Visa interview in 3rd week of November in Mumbai. My parents applied for my visa in 2003. I am currently in a live in relationship without marriage. My partner got pregnant in June 2011. If I get visa in November, Can I marry her in Jan/Feb after returning from US? Can I apply visa for my partner and child when I go back to US?

    hi..yes you can apply for your partner and child after u get ur greencard. Had you already had a child, it would have been possible to add him to the application aswell and he cud have got greencard with u. But anyways you can file for ther gc after u come back again and get married etc ..

      F2B Marriage

      As We all know that In India, it is not common to live with your partner before marriage. Your case is very suspicious to Visa Ofiicer. It is highly likely that Visa officer will try to find out the Truth about your marital status before they issue you visa. They will make phone calls to your neighbor's and will go to your neighborhood to find out about your marital status. If they found out that you are married they will not issue you a visa and INS will revoke your petition. I hope that all of your neighbor's understand that you are not married. Even if one out of TEN of your neighbor's told them that you are married then you will be denied visa. People in India will say something wrong (instead of saying I don't know) without knowing the facts. I have seen similiar case's like your's where visa was denied and petition was revoked.

      Since your case is very suspicious, I would suggest that if your sponsoring parent has got citizenship then change your category to F3 after your marriage.

      MAKE Sure that you do not mis-inform or Lie to the Visa Officer, penalty for lying to visa officer can be NO US Visa for rest of your life.

        1) Technically if you dont have a marriage certificate you are not married.

        2)If you go by book of law..you need to answer only to the questions as asked by consul officer. Its very evident that you would be asked this question ..whether you are married or not. If you are not married you are not.. there is no reason to worry.

        3) However if you have married according to rituals and are yet to get marriage certificate...then its based on fact and circumstances whether its considered as a marriage or not...so i wud suggest its a grey area. You can check with other forums or a lawyer.

        One of my friend is in live in relationship..he is based in Kenya though..He got his f2b visa eventhough he has 7 yr old daughter.

          F2B marriage.

          1. If you need to probe that you are married then you need marriage certificate, If you need to probe that you are not married your need statements from your neighbor's and your live in partner's neighbors.

          2 I agree that you don't need to worry if you are not married. But you should be WORRIED about your neighbor's statements about your marital status. How many of your neighbor's will say that you are not married. Llive in partner is not common in India and Consular office know all about it and they go through this everyday.

          3. I have mentioned earlier that Consular officer will call your neighbor's or personally visit your neighbor's and will find about the TRUTH about your marital status. They need statement only from one person that you are married if they get it your visa will be denied.

          4. Culture and customs play's a big role. If your were in westerner country, It should not been a problem like Mr. Mehta has mentioned about a case in Kenya. I know about four similar case's including one for my sister.

            I agree with Dhira , that culture and customs play a very significant role.
            But if you are not married you are not married..! If you are asked the question you are married or not..then you have to say No i am not married. If they ask you why..you can tell them that you are aware of the fact that this is a f2b application and it would be not applicable for a married person to be elligible to get green card under this category.

            Or alternatively get married, ask your parents to become US citizens and file for your family as f3 category.
            I am surprised what you mentioned on DS230 forms where it has all the options married,single, do you have kids etc..consul officer will appreciate your honesty..so whatever you have written will be reviewed by them.

            Dont blow ur chances by lying.
