  • Green Card For Alien Parents Of US Citizen

    Hi There,

    I am just starting the process for applying for a green card for my parents, and I am a little confused by the plethora of information and forms that I am seeing on the web.

    Here's a brief summary of my case:
    - I am a US Citizen (by birth), over the age of 21, and residing in the US
    - Both of my parents are Indian citizens, and have been residing in India for the last 20 years
    - I have a younger sibling who is also a US Citizen (by birth), and residing in the US

    My parents are really old now, and I am hoping that they can come stay with me in the US. As I was going through the forms and instructions, I think the first step would be to file an I-130. I am confused about what the process should be after the processing of the I-130 (assuming that my petition is accepted).

    Is it at this point that a I-485 would need to be filed? Where/when does the I-864 form come in?

    Also, my parents would remain in India while the petition/application is pending/being processed (that is, they are not planning to be in the US during the process)

      You need to file I-130 first.
      You mentioned that they will be in India during the whole process, this means you are doing "Consular processing", so there is no I-485. There will DS-230, but that is little later.
      Once you file for I-130, start collecting the civil documents needed for DS-230.
      After approval of I-130 it will move to NVC and you will need to file AOS (Affidavit of Support).
      Once all Civil documents are ready you will file DS-230
      You should then receive a Interview letter. They should complete the Medical examination in India once the interview is scheduled and then complete the interview.

      This is juts an overview. You will need to go through all the details available at this site for each step.
