  • Need to travel to Iceland but still waiting for AP

    Hi,

I have a question about Advance Parole Travel Document.
I live in San Francisco, California, as a Icelandic citizen and came here on J1 visa.

I met my wife here in the state and she is a US born citizen.
We got married and sent our paperwork to USCIS November 4th and got the I-797 Notice of Action on November 21st.

The issue is that I need to travel to Iceland on December 17th till January 4th with my wife to meet extended family.
We are beginning to panic since I haven't event got my biometrics appointment notice yet.

The receipt for the I-485 is the only one that wait that USCIS will schedule a biometric appointment for met.
It doesn't say that on the I-131 receipt. Is it possible that I would not need biometric appointment for my AP since I had J1 and went through that process in the US Embassy in Iceland when I came here originally?

I did also make InfoPass appointment on December 9th. to try to ask for a expedited travel document.

Is it reasonable for me to think that I'll be able to get the travel document?
    - I'm married to a US Citizen
    - I've my I-797 Notice
    - We bought the plane tickets 3 months ago (costs $2000)
    - The travel time is less than 3 weeks and over the Christmas Holliday
    - Iceland is part of the visa wavier program.

If I'm not able to get the travel document.
Would there be anything I can do or say so I can go to Iceland over the holidays?

You should not travel outside of the U.S. until you get the advance parole.

Many other reasons that you mentioned don't matter (such as Iceland is part of VWP.)
